Additional Protections for Department of Defense Personnel Against Personal Liability
for Performing Their Official Duties
 

   On February 13, 2023, the Deputy Secretary of Defense issued a memorandum entitled “Additional Protections for Department of Defense Personnel Against Personal Liability for Performing Their Official Duties.”  Pursuant to this directive, the Department may provide certain financial support to civilian employees and Service members who are subject to personal civil or criminal liability for matters arising from performance of their official duties. 
 
   This includes, in appropriate instances as outlined in the memorandum, indemnification for verdicts, judgments, or other monetary awards; payment for all or part of a settlement or compromise of a claim; or reimbursement for the cost of legal representation by private counsel in certain proceedings.
