ASSOCIATE GENERAL COUNSEL

DHRA’s Office of General Counsel (OGC) is seeking to fill a nonsupervisory Attorney-Advisor (GS-0905-15) position.  DHRA is a Department of War (DoW) Field Activity aligned under the Under Secretary of War (Personnel & Readiness).  It is a multifaceted organization with a wide-ranging mission set (https://www.dhra.mil/).  The incumbent Associate General Counsel reports to the General Counsel, DHRA.  The General Counsel and attorneys in DHRA OGC are part of the Defense Legal Services Agency (DLSA), reporting to the Deputy General Counsel (Personnel & Health Policy) and ultimately to the General Counsel, DoW.

DHRA OGC advises the DHRA Director, DHRA staff, and the various DHRA centers/offices on the full spectrum of legal and policy issues affecting the planning, resourcing, execution, and training in support of DHRA’s varied missions.  In addition to the unique legal issues related to DHRA’s programs, DHRA OGC also provides legal and prudential advice on legal functions common to Federal government agencies such as acquisition, labor and employment law, civil and administrative law, fiscal law, ethics law, FOIA and Privacy Act, intellectual property, and related areas of practice.

This position is focused on contracts law, fiscal law, and government ethics law, and the incumbent will accordingly be responsible for the following duties: 
 
  • Government contracts and acquisition responsibilities include subject matter expertise of federal acquisition laws and regulation and independently reviewing and advising Agency Leadership, Requirements Developers/Owners, Contracting Officers and Specialists, and Technical Evaluation Boards on acquisitions—both direct and assisted—as well as interagency agreements. Experience with GSA is helpful.  The incumbent should also have experience with the Procurement Integrity Act and FAR 3.104. This area of practice also entails keeping up to date with changes in federal procurement law and policy as well as litigating cases before GAO, ASBCA, and/or COFC. 
  • Fiscal law responsibilities include advising on proposed actions related to the obligation and expenditure of appropriated and non-appropriated funds, to ensure compliance with fiscal statutes and regulations.
  • Government ethics law responsibilities include the management and administration of the DHRA ethics program, inclusive of ethics training, OGE 278 and 450 financial disclosure report review, and provision of ethics opinions (conflicts of interest, impartiality, gifts, misuse of position, use of government resources, and other Title 5 CFR, Chapter XVI matters).  
  • Other duties as assigned.

The incumbent’s additional duties involve providing legal support to DHRA’s programs, offices, and centers.  As this support is wide-ranging, some experience in information law, intellectual property, and labor and employment law is preferred.

DHRA is headquartered at the Mark Center in Alexandria, VA and has official locations at The DoD Center (Seaside, CA); Fort Knox, KY; Patrick Space Force Base, FL; Pensacola Naval Air Station, FL; and Travis Air Force Base, CA.  Work location from a DHRA site is flexible consistent with agency policy.

Summary
The Deputy General Counsel (Fiscal) position is in the Office of General Counsel (OGC). The General Counsel of the Department of War (DoW), who is appointed by the President by and with the advice and consent of the Senate, is the chief legal officer of the Department of War and principal legal advisor to the Secretary of War, with final authority and responsibility for establishing the Department's position on legal matters and delivering legal services throughout the DoW and its components.

Duties

Major duties and responsibilities include, but are not limited to:
  • Provides legal advice and services to the Under Secretary of War (Comptroller) and his or her office and other Principal Staff Assistants within the Office of the Secretary of War on matters involving federal appropriations law and the Department's exercise of its comptrollership and financial management authorities and responsibilities and, in coordination with the General Counsel, Department of War, provides legal counsel to the Secretary of War and the Deputy Secretary of War on such matters.
  • The Under Secretary of War (Comptroller) relies upon the Deputy General Counsel (Fiscal) for assistance in developing the Department's financial management policies and in executing the Department's budget. The incumbent is consulted and actively participates in developing and ensuring the legal sufficiency of all OUSD(C) issuances regarding such matters.
  • Incumbent reviews directives, instructions, regulations, and all significant correspondence pertaining to his or her area of responsibility for legal sufficiency and ensures that such documents are revised as necessary.
  • Incumbent also reviews for legal compliance with federal appropriations law, all such papers referred to the Under Secretary of War (Comptroller) for his or her approval or concurrence.
  • Incumbent furnishes legal advice and assistance on questions that arise during the formulation, presentation, and execution of the DoW portion of the President's annual budget submission, providing counsel to the Under Secretary of War (Comptroller) and
    key members of his or her staff.
  • The incumbent reviews for the Under Secretary of War (Comptroller):
    • The DoW Legislative Program items having a fiscal impact to establish and present the views of the Under Secretary of War (Comptroller) and provide the basis for integration of the Legislative Program within the budgetary plans and policies of the DoW.
    • Emergency legislation having a fiscal impact.
    • Bills introduced in Congress and referred to the Under Secretary of War (Comptroller) for review and comment.
  • Directly responsible for reviewing the legal sufficiency of Do W' s financial implementation of all statutes relating to the Department, as well as for the proper implementation of the general provisions of the annual DoW Appropriations Act.
  • Renders advice and legal opinions on matters that impact virtually all substantive and operational programs of the Department of War, because requirements regarding the use, control, and accounting for funds directly or indirectly influence the nature, scope, and methods of conducting DoW business at all operating levels.
