Mission and Function

The Office of Legislative Counsel (OLC) provides legal advice to the Secretary of Defense and all Department of Defense (DoD) components on matters concerning legislation, Congressional testimony, and Executive orders; manages the DoD legislative program, which includes developing, coordinating, and submitting annually the largest and most complex piece of Federal legislation-the National Defense Authorization Act; conducts legal and policy reviews of DoD legislative proposals and views reports on legislative proposals that originate outside the Department; and coordinates with the White House Office of Management and Budget for clearance of DoD legislative proposals, views reports, and Congressional testimony.
OLC also provides legal counsel to the Office of the Secretary of Defense, military services, and other Department components regarding how to respond to high priority Congressional investigations. Pursuant to DoD Instruction 5400.04, all components must coordinate responses to Congressional document and interview requests (or subpoenas) with OLC. Through such coordination, OLC provides privilege review for high-level communications, coordinates with other Agencies as needed, and serves as Agency counsel in interviews where claims of executive privilege may arise. During the 110th Congress, OLC reviewed and produced over 550,000 pages of documents to Congress, and served as Agency counsel in some 50 interviews of Department personnel by Members of Congress and congressional staff.
